Necessary Documents

                       
 

To register your marriage, you will need the following documents
(Legal basis includes § 6 Personenstandsgesetz-Durchführungsverordnung– see: www.ris.bka.gv.at/GeltendeFassung.wxe):

  • Birth certificate (or, for example, if someone was born in Germany, an extract from the birth register not older than 6 months)
     
  • Proof of citizenship (for foreign nationals: passport)
     
  • Proof of residence (not required if you are currently registered in Austria); German nationals need confirmation of registration from their (last) place of residence in Germany
     
  • Marriage certificate of the previous marriage
     
  • Proof of dissolution of the last marriage (divorce decree with confirmation of legal force or death certificate of the former spouse)
     
  • Birth certificates of any joint children born out of wedlock(paternity acknowledgment)
     
  • Optional: Proof of academic degrees or professional title Ing. (Diploma)
     
  • For persons who are not yet of legal age (i.e. under 18):
    • Consent of legal guardians and custodians
    • Declaration of marriage eligibility (issued by the district court), if the person has reached the age of 16 and the future spouse is of legal age

NOTE: This does not apply to registered partnerships – legal age is required in that case.

For persons with foreign nationality (in addition):

  • Certificate of marital capacity: This is confirmation from the competent authority in your home country stating that there are no legal obstacles to marriage. This certificate is usually valid for a limited period (generally 6 months)
     
  • Countries that do not issue a certificate of marital capacity instead provide certificates of single status or other relevant documents, such as sworn declarations
     
  • Recognized convention refugees: Certificate confirming refugee status

NOTE: Please be aware that your home authority may require additional documents to issue a certificate of marital capacity and that it may take several weeks (in some cases, months) to obtain. Therefore, you should contact your home authority well in advance!

Foreign civil status documents will – depending on the country – either be accepted as is or will require legalization or an apostille.

Foreign-language documents must be accompanied by a certified translation.
